What are consent orders?

Consent orders are a formal court order made by agreement. You and your former partner work out what’s been decided, we draft the orders and the supporting application, and the court reviews and approves them without either of you needing to attend.

Once approved, the orders are as legally binding as any other court order, which means both sides have certainty, and enforceability if something goes wrong later.

  • Only require one set of legal representation (though independent advice is recommended)
  • More affordable for most couples
  • Best where you want certainty and enforceability
Binding Financial Agreement (BFA
  • A private contract: no court approval
  • Each party must have independent legal advice (so two sets of legal fees)
  • More flexible: can be made before, during, or after a relationship
  • Best for pre-nuptial-style arrangements or where court involvement isn’t wanted
